Frequently Asked Questions: Annual Leave
You are entitled to a lump-sum payment if you have worked for the same employer for at least 5 years and:
- Your employer ends your contract (for reasons other than serious misconduct).
- Your contract expires and the employer does not offer to renew it.
- You resign due to health reasons (with a doctor’s certificate).
- You are aged 65 or older and choose to retire.
- You pass away while in service (payment goes to your next of kin)
On 1 May 2025, the law in Hong Kong changed for everyone.
- Period 1: Any years you worked before May 2025 are “locked” at your April 2025 salary rate.
- Period 2: Any years you work after May 2025 are calculated at your final (possibly higher) salary rate. The calculator does this automatically to give you a legally accurate estimate.
No. If you choose to leave your employer to find a new job or return home before you are 65, you are generally not entitled to Long Service Payment. It is only paid if the employer makes the decision to end the relationship or if you are retiring/unfit for work.
The basic rule is: (Monthly Salary × 2/3) × Years of Service.
However, due to the law changes on 1 May 2025, the actual calculation is slightly more complex. Our Long Service Calculator above uses your exact period of employment, and incorporates the latest rules, to give you a more precise estimate.
No. Long Service Payment is a separate legal entitlement. Your employer must pay your full final month’s salary plusyour Long Service Payment within 7 days of your last day of work.

Yes. By law, the most anyone can receive for Long Service Payment is HK$390,000. Most domestic workers will not reach this limit, but the rule applies to everyone in Hong Kong.
